After going through the facts in both persons argument, choose the best course of action that will resolve the issue.

If you want to do something a bit more formal, you could prepare a small mock trial with a group of friends for your class at school.

Cooperative Learning Activity

1. This activity is for the whole class. There are 10 roles to undertake. It is suggested that there are two people per role and the rest of the class will act as jurors.

The Roles are:

a. One of his sisters
b. Mr Bindon, a young, inexperienced barrister who defended Ned
c. Mr Charles Smyth, Prosecutor
d. Justice Redmond Barry
e. Ned Kelly
f.  Constable McIntyre - Crown Witness
g. Dr Reynolds
h. Daniel Kelly
i. Joseph Byrne
j. Stephen Hart
k.Constable Fitzpatrick

2. Divide up into 10 students per group and read through these websites by allocating 1 - 2 websites for each student. Remember you are to particularly look at your role or that of a juror but also of the other roles within your group. 

You might like to undertake the Expert Jigsaw Strategy within your group as long as you can be certain of obtaining information about your role.

3. Read through these websites:

4. After reading through the above websites, make a Presentation about the Life of Ned Kelly from your roles or that of a juror or even a jailer.

5. Look up the Reactment of the Trial of Ned Kelly at ABC's Law Report - The Trial of Ned Kelly; and, using the information that you have gained from the websites, create your own "Trial of Ned Kelly" by maintaining your roles. 

6. Debate within the class about the question:

"Should Ned Kelly be regarded as a National Hero?"

5. Using the creative skills of the group, create either a song, poem or skit about your chosen issue.
